The tenant must within seven (7) days of the date of this order: (a) Allow the landlord reasonable access to the premises for the purpose of inspection, in accordance with section 48 of the Residential Tenancies Act 1986. (b) Remove any unauthorised gates and restore the original gate to a usable condition. (c) Arrange with the landlord a reasonable repayment plan for the outstanding rent arrears of $981.43. (d) Repair the broken window to a reasonable standard. (e) Remove the fridge freezer full of rubbish from the section.
If the tenant fails to comply with any of the above conditions within seven (7) days, the tenancy will terminate at 3B Crewe Crescent, Hokowhitu, Palmerston North 4410 will terminate and the landlord will have immediate possession of the premises and the balance of the debt will be payable immediately.
If the tenant complies with all the above conditions within the seven-day period, the tenancy will continue.

Reasons

The landlord attended the hearing.
The landlord has applied for termination of the tenancy and rent arrears. The landlord wishes to allow the tenant a final opportunity to engage with the landlord, remedy the outstanding issues and continue in the tenancy.
The landlord has provided rent records showing that the tenant owes $981.43 being arrears to 9 September 2025.
The landlord has issued 14-day breach letters on 13 and 30 May 2025 requiring the tenant to: a. Remove the metal gate on the driveway. b. Reglaze the window in the kitchen/dining room area. c. Remove the fridge freezer full of rubbish from the section. d. Fix the frame of the window near the porch. e. Allow access for inspections on 30 May and 19 June 2025.
The tenant has not remedied the breaches nor allowed the landlord access to inspect. The Tribunal is satisfied that it is appropriate that the tenancy be terminated because the rent is more than 21-days in arrears, the tenant has denied the landlord access, the tenant has continued to breach the terms of the tenancy agreement and RTA having received notices for breaches that could be remedied, and it would be inequitable to refuse to terminate the tenancy. See sections 55(1)(a), 48 and 56(1) RTA.
The landlord wishes to work with the tenant in resolving the outstanding issues and asked that a conditional termination order be made so that the tenant has a final opportunity to engage with the landlord in resolving these issues. It is appropriate in these circumstances that the Tribunal grants a conditional order as requested. See section 78(3) RTA.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
