What is the rent position at the end of the tenancy?
- The tenancy began in January 2020 and ended in July 2025 pursuant to Tribunal Order.
- The landlord provided an updated rent record which establish the rent credit at the end of the tenancy and the payments the tenant has made towards the costs incurred by the landlord during the tenancy that she agreed to pay at the time.
- This order will consider whether those costs can be awarded to the landlord under the relevant provisions of the RTA.
Did the tenant comply with their obligations during the tenancy?
- During a tenancy a tenant must keep a property reasonably clean and tidy and free of rubbish. (s45)
- The tenancy agreement required Ms Kohere to keep the home and grounds in a tidy condition.
- On several occasions during the tenancy the landlord received complaints regarding long lawns and excessive rubbish at the property.
- Ms Kohere agreed on several occasions during the tenancy that to rectify the breaches, the applicant would arrange for the rubbish to be removed and the lawns and gardens attended to and she would pay the associated costs.
- The landlord invoiced her for these charges, and she made regular payments which are deducted from the amount ordered.
- Having considered the contemporaneous photographs and evidence provided from the relevant periods which also confirm the neighbours’ complaints, I agree that Ms Kohere is responsible for the charges associated with the excessive rubbish and the very overgrown lawns and section that occurred on multiple occasions during the tenancy.
- In summary I am satisfied the charges Ms Kohere agreed to pay during the tenancy and awarded above are reasonable and must be awarded as requested.
- The amounts ordered are therefore proved by the evidence provided.
- No request for reimbursement of the filing fee was made so this amount is not awarded.
