Order
- The Order of the Tribunal dated 27 November 2025 is reinstated as follows.
- Jamie Cassidy must pay Richard Stoks $2,953.34 immediately, calculated as shown in table below.
Reasons
- The landlord attended today’s rehearing; the tenant did not.
- On 3 December 2025, the Tribunal granted a rehearing of the claim at the behest of the tenant. This rehearing is scheduled at 2pm today which is only attended by the landlord.
- The court records show that notice of today’s hearing has been duly sent to the tenant on 17 December 2025. On 19 December, the tenant contacted the Registry seeking a copy of the application. I am satisfied that the tenant has had notice of today’s rehearing. The tenant did not attend this rehearing.
- The Tribunal has earlier on 27 November 2025 ordered $2,953.34 to be paid by the tenant to the landlord for rent arrears to the 22 August 2025, lock change, removal of rubbish, wall repairs, insurance excess for testing/decontamination of methamphetamine, the filing fee and the bond to be refunded to the landlord.
- The landlord has since received the bond pursuant to the Tribunal order of 27 November 2025.
- Given the non-attendance of the rehearing by the tenant, I consider it appropriate that the Tribunal order of 27 November 2025 is reinstated, including the reasons set out in the order for the tenant to pay the landlord $2,953.34.
- The landlord may keep the bond.
- Accordingly, there will be a monetary order as set out above.
