Decided 8 January 2026 · Published 8 January 2026 · Application 5383961
Landlord favoured
- Rent arrears
Order
- Renee Carter owes Fahey Property Management Limited As Agent For Kerry Burridge And Ian Mcwilliam As Trustees For Skali Trust $908.00 being outstanding rent arrears of $880.00 and reimbursement of the filing fee of $28.00 (“the debt”).
- The tenant is to pay the landlord the debt by paying $10.00 extra per week, together with the current rent of $470.00 from next Tuesday 1 January 2026.
- Payments received from the tenant shall be applied first to current rent, then to the arrears and finally to the application fee.
Reasons
- The landlord attended the hearing by video.
- The tenant was telephoned twice but did not answer.
- The landlord has applied for rent arrears and has provided rent records which prove the amount owing.
- The landlord advised that the tenant has started to reduce the arrears by making payment of $10.00 extra per week. The landlord confirmed that this was a satisfactory arrangement and asked that it be recorded in an order of the Tribunal.
- The tenant is urged to stick with this arrangement. If the tenant breaches this Order then the landlord may make a further application for termination of the tenancy.
- Because Fahey Property Management Limited As Agent For Kerry Burridge And Ian Mcwilliam As Trustees For Skali Trust has wholly succeeded with the claim I must reimburse the filing fee.
