Reasons
- Only the landlord attended the hearing.
- Since the last hearing, the parties have agreed that the bond could be released to meet some of the costs the landlord was claiming.
- The landlord is now only seeking the balance of the cost incurred in repairing holes in the walls and removing oils stains from pavers.
- The landlord submitted photographs showing a few holes and some oil stains.
- The landlord does not have an entry report because they have taken over management of the property from another property manager and this was not supplied.
- The landlord has the burden of providing their claim on the balance of probabilities. They must prove that it is more probable than not that their version of events is correct. Corroborating documents such as reports and photographs can be useful to assist the tribunal in determining what has taken place.
- In the absence of corroborating evidence as to the condition of the property at the outset of the tenancy I have nothing before me that confirms that the holes and oil spills were caused by the tenant.
- I therefore dismiss the claim.
- I have other concerns about the claim too, as to whether the cost incurred for remedying these issues was reasonable but since I am dismissing the claim on the grounds the landlord has not proven their case I do not need to consider those aspects.
