- The tenancy of Salome (known as Rita) Tualata at 16 Cheshire Street, Cannons Creek, Porirua 5024 is terminated, and possession is granted to Patrick Ian McElwee and Lynley Reid, today Wednesday 7 January 2026 at 11.59 pm.
- Salome (known as Rita) Tualata must pay Patrick Ian McElwee and Lynley Reid $5,357.11 immediately, being rent arrears to termination of $5,329.11 and reimbursement of the filing fee of $28.00.
Reasons
- The landlord attended the hearing by telephone.
- The tenant was telephoned twice but did not answer and messages were left.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- Because Patrick Ian McElwee, Lynley Reid has wholly succeeded with the claim I must reimburse the filing fee.
