Reasons
- The landlord attended the hearing held on 25 February 2026 by video. The tenant did not join the hearing. An attempt was made to join the tenant to the hearing by telephone, but the call went to voicemail.
- The landlord has applied for rubbish removal following the end of the tenancy. The amount sought is $4,481.25 for 25 cubic metres of rubbish.
- The tenancy ended on 31 August 2025 after just under ten years. The landlord did not produce any photographs from before the tenancy.
- The inspection report dated 4 September 2025 makes no mention of rubbish left by the tenant. It states that the overall exterior condition is average. At the end of the report, it states that the “property is neat and tidy. Customer has left any unwanted belongings to pile them up in the carport/shed.”
- The photographs in the report show some items left under the house, in a shed and under and beside the carport. The photographs do not show 25 cubic metres of rubbish.
- There is a corrugated iron fence next to the carport. It is not clear whether this forms part of the rubbish for removal. If the landlord produced the pre tenancy photographs the Tribunal would be able to determine whether this was part of the rubbish.
- For the above reasons I am not satisfied that the tenant should be responsible for the amount of rubbish that the landlord is claiming for removal. Instead, I have reduced the claim to $1000.00 and that amount is awarded.
