- The application is dismissed.
- Kāinga Ora–Homes And Communities is granted a period of 28 days within which, if they are able to prove service on the respondent in accordance with the Residential Tenancies Act, 1986, (the “RTA”) section 91A, they can request that the application be brought back before to the Tribunal and the matter will be re-opened.
Reasons
- The landlord attended the hearing which was held by video conference. The tenant did not seek to be admitted to the hearing at the scheduled time.
- The tenant has been served notice of the hearing to an email address which is not included on the tenancy agreement as an address for service. This does not comply with the service requirements set out in section 91A of the RTA.
- A party to an application has a right to be informed of the claims being made against them so they can consider and respond to the claims.
- This requires that they be served notice of the claim to an address that is a lawful address for service. Ultimately this is the responsibility of the applicant.
- To undertake a hearing without this having happened would amount to a miscarriage of justice.
- Unless service is made correctly, the hearing cannot proceed.
