- The landlord attended the hearing, set down to be conducted via video conference. There was no entry into the conference by the tenant, nor any call in to the conference by one of the telephone numbers provided on the Notice of Hearing. I was satisfied adequate service had completed and I continued with the hearing.
- The landlord has applied for rent arrears, compensation, and refund of the bond following the end of the tenancy.
How much is owed for rent?
- The tenancy ended on 28 October 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy was $724.00 but since reduced to $584.00 by tenant time payments applied against the rent arrears.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The tenant did not remove all rubbish. The landlord provided rubbish removal invoices for $174.36 (general rubbish) and $53.61 (tyres) from vacate. Entry and exit photos evidence the need.
- This was a long tenancy, since 2018, and in 2024 the landlord had over twenty tyres and associated wheel parts removed at a cost. This cost included a large skip bin with the tenant liability capped at $800.00 (the invoiced cost was $1,090.00). The tenant has additional time payments since that date recorded although these have been applied to rent arrears. I accept it more than likely that the cost was incurred and the tenant accepted liability at that time. The cost of $800.00 is awarded.
- The tenant did not attend to the lawns at exit. The exit photos show the large lawn area as overgrown and in need of cutting. The landlord claimed $89.84 per the submitted invoice. This is awarded.
