- The tenancy of Leena L Le at 9 Holcroft Street, Papakura, Papakura 2110 is terminated, and possession is granted to The Rent Shop Limited As Agent For Divay Gupta, immediately.
- The hearing is adjourned.
Reasons
- The landlord has applied for termination of the tenancy for abandonment through the expedited process under section 91AA of the Residential Tenancies Act 1986 (RTA).
Are there grounds for an expedited application?
- I am satisfied that the two requirements for the expedited process are met: a. The tenant does not want to contest the abandonment application. b. The information provided by the landlord with the application is sufficient to enable the Tribunal to determine it properly without a hearing (either on the basis of that information alone or with only minor clarifications).
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. (See section 61 of the RTA.) A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- In the landlord’s application, the agent for the landlord states that they believe the premises to be abandoned because on 03 December 2025, the landlord who lives next to the premises, advised the agent that the ranch slider and the blinds at the premises had been left open and he could see that the tenant’s belongings had been removed.
- The agent said that they inspected the premises on 08 December 2025. The agent has provided photographs from that inspection. These photographs show that the premises have more likely than not been abandoned.
- The landlord has also provided a rent ledger showing that the tenant has been in rent arrears since 02 December 2025.
- I find that the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises on 03 December 2025.
- As the premises have been abandoned, and rent is in arrears, I am terminating the tenancy immediately.
- All the requirements for an expedited abandonment application have been met.
- If the landlord has any other claims relating to the tenancy, the landlord will need to file a new application and pay the corresponding fee.
