- Jancee-Puka Meti owes GG Blue Enterprises Limited T/A Propertyscouts Manukau as agent for Leo Waenga $3,675.92 (“the debt”) as calculated in the table below.
- Jancee-Puka Meti must pay rent and the debt as follows: a. By 36 weekly payments of $780.00, being $680.00 for rent and $100.00 for the debt. b. A final payment of $755.92, being $680.00 for rent and $75.92 for the debt. c. Payments will be every Saturday, with the first payment on 28/02/2026 and continuing until 07/11/2026.
- Payments will be allocated in the following order: rent, and then the debt.
- If the tenant fails to pay rent or the debt within 2 working days of the due dates: a. The tenancy at 17 Marumaru Lane, Manurewa, Auckland 2102 will terminate and the landlord will be entitled immediate possession of the premises. b. The balance of the debt will be payable immediately. Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. 1
- Ms Meti lives in the premises with her two teenage children. She says WINZ has assisted her to pay the rent previously and that she will seek its urgent assistance with keeping the tenancy.
- I am satisfied that it is likely the tenant can with WINZ’s assistance pay the debt within the period specified in this order and therefore is unlikely to commit any further relevant breach. The Tribunal therefore makes a conditional termination order.
- If the tenant does not pay the weekly rent or the weekly repayment ordered by the due dates, the tenancy will terminate, and the landlord may take back possession of the premises.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. 2
