Order
- Fomai Faoa and Peati Tu’itea owes Kāinga Ora–Homes And Communities $406.10 (“the debt”) being rent arrears for the period ending 25 March 2026.
- Fomai Faoa and Peati Tu’itea will pay the debt by weekly payments of $50.00 commencing on Thursday 26 March 2026 and continuing every Thursday until the debt has been paid in full. These payments are in addition to normal weekly rent of $198.00 making the total to be paid each week $248.00. The next payment of normal rent is also due on Thursday 26 March 2026.
- Any payments made will first be credited to the normal weekly rent and then to the debt.
- Failure to pay the debt and normal rent as set out in order 2 within 5 working days of the due dates will result in immediate termination of the tenancy with possession of the premises returning to the applicant, and all monies still owing will be payable immediately.
Reasons
- Mr Temu attended the hearing for the landlord. The tenants were phoned on the number provided but the call went to voicemail.
- The landlord has applied for termination of the tenancy on the basis that the tenants were more than 21 days in arrears with rent on the date of the application: s 55(1) of the Residential Tenancies Act 1986. The landlord also applied for a rent arrears order.
- However, Mr Temu confirmed that the landlord is prepared to give the tenants the opportunity to pay off the remaining rent arrears to avoid immediate termination.
- The conditional termination order will lapse if it is fully complied with. If the tenants breach the order, the possession order may be enforced for 90 days from the first breach: section 64(4)(b) Residential Tenancies Act 1986.
