Order
The tenancy of KIERAN MARK ALEXANDER DONOVAN at Unit/Flat 5, 38 Percival Street, Rangiora, Rangiora 7400 is terminated, and possession is granted to Kāinga Ora–Homes And Communities, immediately.
Reasons
- Only the landlord attended the hearing.
- The landlord has applied for termination of the tenancy.
- Rent was at least 21 days in arrears on the date the application was filed on 7 January 2026. The tenancy is terminated under section 55(1)(a) Residential Tenancies Act 1986.
- The Tribunal may also terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
- The tenant has breached his obligations by failing to live and reside at the premises in breach of clauses 13 and 14 of the tenancy agreement.
- It would be inequitable to refuse to terminate the tenancy because the tenancy was let to him based on social needs. The landlord is a social housing provider. The property should be freed up to enable it to be rehoused to other social housing tenants who will actually be occupying the premises.
- This tenancy is therefore terminated pursuant to sections 55 and 56 of the Residential Tenancies Act 1986.
