The tenancy of Auomanu E-Sili at 8B Finlayson Avenue, Clendon Park, Auckland 2103 is terminated and possession is granted to Kāinga Ora–Homes And Communities, at 11.59 pm Monday 23 March 2026.
The tenant is to pay the landlord $2,248.71 immediately, being rent arrears to termination.

Reasons

The landlord attended the video hearing.
The tenant did not join the hearing by video or telephone. The tenant was telephoned but did not answer and so a message was left.
The tenant has claimed to the Tribunal that she has not had adequate notice of the hearing and the landlord’s claim. In addition to being properly served, the tenant was sent a further copy of the Notice of Hearing and the landlord’s application yesterday afternoon.
The tenant was served the Notice of Hearing by email to her electronic address for service recorded in the tenancy agreement and by text.
The tenant has not paid any rent since 11 December 2025, a period of more than three months. The landlord gave evidence that a breach letter for rent arrears was sent on 10 December 2025 and a further letter noting that her tenancy was at risk was sent on 8 January 2025. In addition, the landlord has repeatedly tried to contact the tenant by telephone and has texted on 21 January 2025 and left a voice message on 2 February 2025 asking that she make contact to discuss the arrears, The landlord also visited the property on 3 February 2026 and notified the person present that the tenant needed to contact the landlord.
The Tribunal is therefore satisfied that the tenant was both served with the landlord’s application and Notice of Hearing in accordance with section 136 Residential Tenancies Act 1986 and has received a number of notifications about the rent issue from the landlord.
The Tribunal therefore determined that it was appropriate to proceed with the hearing in the absence of the tenant.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
