After 4:30 pm on 6 May 2026, Kāinga Ora–Homes And Communities may dispose of the tenant’s goods left at the premises as the landlord sees fit. Kāinga Ora–Homes And Communities must take any of the tenant’s personal documents that have been left at the premises to the nearest Police station and obtain a receipt for them.

Reasons

Both parties attended the hearing.

The landlord has applied for the disposal of goods the tenant left at the premises at the end of the tenancy.

The tenant applied for exemplary damages and monetary compensation.

The tenancy ended on 26 November 2025 after the High Court dismissed the tenant’s appeal of the original Tribunal order dated 5 November 2024 ending the tenancy on 3 December 2024.

Since then, the tenant had been given time to collect her belongings from the premises during the agreed times. However, due to the tenant’s long tenure at 5423168, 54359682 the premises, immense amount of goods, and the tenant’s ill physical health, the tenant was unable to completely remove her goods.

The landlord and the tenant had an agreement for access that allowed her to collect her goods. However, the tenant sought for more time.

I find that the landlord has been more than reasonable in allowing access for the tenant so far.

To give the parties some finality, I give the tenant final two weeks to collect her goods.

After 4:30 pm 6 May 2026, Kāinga Ora–Homes And Communities may dispose of the other goods left at the premises by the tenant as the landlord sees fit. Kāinga Ora–Homes And Communities must take any of the tenant’s personal documents that have been left at the premises to the nearest Police station and obtain a receipt for them.

The tenant’s cross-application for exemplary damages is dismissed as there is no basis.

The tenant’s monetary claims were raised just before this hearing. There is insufficient evidence for it to be determined at this stage. Should there be any further claims between the parties regarding end of the tenancy cleaning or rubbish removal, the tenant’s monetary claims should be revisited at that stage.
