- The application is dismissed.
Reasons
- The landlord attended the hearing held on 24 March 2026 by video. The tenant did not attend the hearing. Attempts were made to call the tenant to join her to the hearing but all calls either did not connect or went to voicemail.
- The landlord applied for rent arrears and water rates.
- At the hearing the landlord advised that the tenant is paying both rent and water rates so sought to withdraw the claims.
- I note from the updated water summary submitted by the landlord that it includes application fees for tenancy tribunal applications. These should not be included in the summary for water. The landlord advised that she would remove these and provide the tenant with an amended summary.
- I also note that if a party is successful in the Tribunal the application fee will usually be reimbursed in the Tribunal order. This is the third application filed by the landlord which has not been successful (one was dismissed 1 and two were withdrawn 2 ). The Tribunal has not reimbursed any filing fee to the landlord.
