Should the tenancy be terminated?
- The landlord has served the tenant with three 14-day notices in a 90-day period requiring him to pay his rent arrears. He did not comply with these notices.
- The landlord has also tried to assist the tenant to get support to pay his rent arrears after his employment ended, but he has not complied with any agreed payment plan.
- Lastly, rent was at least 21 days in arrears on the date the application was filed, being 13 January 2026. Under s 55(1)(a) of the RTA, where any application is made to the Tribunal for termination of the tenancy, the Tribunal must terminate the tenancy if it is satisfied the rent was in at least 21 days arrears on the date the application was made. The landlord proved the rent was more than 21 days arrears on 13 January 2026. Therefore, the tenancy is terminated as at 5:00pm today.
