- Craig Smith owes Rent Wise Property Management Limited $2,377.99 (“the debt”) as set out in the table below.
- Craig Smith must pay rent and the debt as follows: a. Rent of $550.00 every Saturday, with the first payment being on 28/03/2026 and continuing until 16/05/2026. b. The debt of $2,377.99 by Saturday 04/04/2026.
- Payments will be allocated in the following order: rent, the debt.
- If the tenant fails to pay rent or the debt within 2 working days of the due dates: a. The tenancy at Unit 5, 80 Mackworth Street, Woolston, Christchurch 8062 will terminate and the landlord will be entitled to take immediate possession of the premises. b. Reasons
- The Tribunal conducted the hearing on Microsoft Teams.
- Shona Brooklands attended the hearing for the landlord.
- The tenant did not attend.
- The landlord had originally applied for termination of the tenancy, rent arrears and refund of the bond. However, today Ms Brooklands invited the Tribunal to give Mr Smith a final opportunity to avoid termination by paying rent and the arrears. Conditional termination order
- Where rent is at least 21 days in arrears on the date the landlord filed their application, the Tribunal must grant a landlord’s application for termination pursuant to s 55(1)(a) of the Residential Tenancies Act 1986. It is only because Ms Brooklands asks for a conditional order that the Tribunal can consider it.
- The tenant must pay rent on time starting Saturday. The tenant must pay the debt by next Saturday. If the tenant fails to make these payments, the tenancy shall terminate, and the debt shall fall due immediately.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach pursuant to 64(4)(b) Residential Tenancies Act 1986.
- The landlord provided a rent summary proving the arrears. I include the rent due to Saturday for convenience.
- The tenant must reimburse the landlord for the filing fee.
