- The Tenant shall pay the debt being $282.86 (“rent arrears”) plus rent $286.00 (due 3 March 2026) to the Landlord by Monday 9 March 2026. If the debt of $568.86.00 is not paid by the due date, the tenancy of Scott Michael Payne and Kayla Sherie Hirst at 17A Exeter Crescent, Takaro, Palmerston North 4412 is terminated, and possession is granted to Kāinga Ora–Homes And Communities, immediately.
Reasons
- The Landlord attended the hearing. The Tenant did not attend. The Tenant was sent a notice of hearing to the email address provided on 20 January 2026 with specific instructions as to how to attend the hearing. During the hearing the Landlord also attempted to telephone the Tenant.
- The landlord has applied for termination of the tenancy and rent arrears.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- The Landlord seeks orders permitting the Tenant until Monday, 9 March 2026, to pay the outstanding rent arrears, failing which the tenancy is to be terminated and possession granted. The current arrears have been reduced to $282.86.
- The Landlord refers to a previous agreement made with the Tenant in December 2025 whereby the Tenant undertook to repay the rent arrears by weekly instalments. However, due to a subsequent increase in rent (which is income-tested), further arrears have accrued.
- Having regard to the reduced amount of the outstanding debt and the circumstances outlined, the Tribunal grants the Tenant one final opportunity to discharge the arrears in full by 9 March 2026. Should the arrears remain unpaid by that date, the tenancy will be terminated and possession of the premises granted to the Landlord.
