- The tenancy of Jamie Mark Thomas at Unit/Flat 1, 22 The Mall, Mount Maunganui, 3116 is terminated, and possession is granted to Crystal Val Harvey, at 11:59pm on 16 February 2026.
- Jamie Mark Thomas must pay Crystal Val Harvey $5,278.09 immediately, as calculated in the table below:
Reasons
- The landlord attended the video hearing. The tenant did not attend, and the hearing proceeded in their absence.
- The landlord has applied for termination of the tenancy, rent arrears and outstanding water rates.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. There is no discretion is this regard. See section 55(1)(a) Residential Tenancies Act 1986.
- I have reviewed correspondence between the parties that suggest the tenant did plan to make payment of the outstanding amount in the future, however, this does not change the outcome.
- The landlord provided rent and water records which prove the amounts owing of $6,857.14 for rent to the end of the tenancy and $392.95 for water to 12 September 2025.
- Because Crystal Val Harvey has wholly succeeded with the claim I must also reimburse the filing fee. R Harvey-Lane 16 February 2026
