Order
- Lisa Marie Hineakura Hori must carry out the following works to the tenancy address, which must be completed by Monday 9 March 2026: a. Remove all rubbish from the interior and exterior of the property. b. Clean walls, floors, ceilings in the kitchen, bathroom, toilet, bedrooms and living rooms at the property. c. Mow the front and rear section of the property within the fence line. (collectively “the works”)
- If the tenant fails to carry out the works within 2 working days of the due date, the tenancy at 10 Norman Street, Waitara, Waitara 4320 will terminate and the landlord will have immediate possession of the premises.
Reasons
- The landlord attended the video hearing. The tenant did not attend, and the hearing proceeded in their absence.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations. However, the landlord is willing to allow the tenant further time to remedy to breaches to avoid immediate termination.
Should a conditional termination order be made?
- The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so. See section 56(1) Residential Tenancies Act 1986 (RTA).
- The tenant breached their obligations by failing to keep the premises reasonably clean and tidy. On 21 November 2025 the landlord served a 14-day notice on the tenant outlining the works that needed to be done to the property (in detail), however the breach was not remedied within the required period.
- It would be inequitable to refuse to terminate the tenancy. The evidence provided shows that there is extensive waste at the property, and this is likely to be causing damage to the property. Inspection notes record that there is rubbish and dog faeces throughout the interior of the property, and that the property is not fit for anyone to live in. The landlord has endeavoured to engage with the tenant over the past 12 months, and there has also been a previous Tribunal work order issued.
- Despite my finding that it would be inequitable to refuse to terminate the tenancy, having heard the evidence and on the basis the landlord wishes to allow the tenant a further period of time to remedy the breaches, I am satisfied the tenant will carry out the works within the period specified in the order and is unlikely to commit any further breach. I have granted a conditional termination. See section 78(3) RTA.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) RTA. R Harvey-Lane 23 February 2026
