Order
- Jennifer Hope Williams owes Mila Nikolic $6,918.00 as calculated in the table below (“the debt”).
- Jennifer Hope Williams must pay the debt of $6,918.00 by the end of Friday 20 March 2026.
- Jennifer Hope Williams must pay weekly rent of $530.00 per week: a. Commencing Friday 20 March 2026. b. Continuing every Friday thereafter until Friday 31 July 2026.
- If the tenant fails to pay the debt referred to in clause 2 of this order by the end of 20 March 2026 or any of the rent payments referred to in clause 3 of this order within 2 working days of the due dates: a. The tenancy at 37 Lambeth Crescent, Redwood, Christchurch 8051 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Reasons
- The hearing was conducted on Microsoft Teams by telephone.
- The landlord has applied for termination of the tenancy, rent arrears and payment over of the bond.
- The tenant wants to repay the debt to avoid immediate termination.
- The arrears stand at $6,587.14 to yesterday and $6,890.00 will be owed to 19 March 2026 with another rent payment also due on that date for the following week.
- The tenant is confident that MSD will help her and her two young children with clearing the debt and meeting future weekly rent.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal if the landlord requires, the Tribunal must terminate the tenancy. 1
- However, in this case Ms Nikolic is prepared to give the tenant a final opportunity to pay the debt by Friday and pay her weekly rent this Friday and every Friday thereafter without fail.
- The conditional order is to run to 31 July 2026. The term is limited because it will be onerous for the tenant to have a sword of Damocles hanging over her for a protracted time.
