- Salote Bueno owes Nielsen Rentals Limited As Agent For Robyn J Hyde $1,955.58 (“the debt”), which is rent arrears to 7 May 2026.
- Salote Bueno must pay rent and the debt as follows: a. By weekly payments of $580.00, being $530.00 for weekly current rent plus $50.00 per week towards the debt, starting on Tuesday 12 May 2026 and to be paid every Tuesday until the debt is repaid in full.
- Payments will be allocated in the following order: rent and rent arrears.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 50 Cheyenne Street, Sockburn, Christchurch 8042 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- Ms Mills and Mr Nielsen, representing the landlord, attended the video conference hearing. The tenant did not join the hearing as per the instructions in the Notice of Hearing and so did not attend the hearing. As the tenant was served, the hearing proceeded in her absence.
- The landlord has applied for termination of the tenancy and rent arrears.
- The landlord said the tenant made two large payments recently towards rent arrears and they have reached agreement with the tenant about weekly payments of rent and extra weekly payments towards the rent arrears debt. The landlord provided a rent summary, showing that $1,955.58 is owing to 7 May 2026 for rent arrears and showing that the tenant has already started making weekly payments of $580.00, as outlined in the order above.
- The landlord requested a conditional termination order be made.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
