- Pela Iese, Faatino Alaifaiva owe Kāinga Ora – Homes and Communities $598.71 for rent arrears (“the debt”).
- Pela Iese and Faatino Alaifaiva must pay rent and the debt as follows: a. By 24 weekly payments of $267.00, being $243.00 for rent and $24.00 for the debt. b. A final payment of $265.71, being $243.00 for rent and $22.71 for the debt. c. Payments will be every Wednesday, with the first payment on 29/04/2026 and continuing until 14/10/2026.
- Payments will be allocated in the following order, and the debt.
- If the tenants fail to pay rent and the debt within 2 working days of the due dates: a. The tenancy at Unit 6, 15 Kokopu Lane, Waterview, Auckland 1026 will terminate, and the landlord will be entitled immediate possession of the premises. b. The balance of the debt will be payable immediately.

- The landlord provided a rent statement that proves the tenants owe $598.71 for rent arrears. At the time the landlord filed its application, the tenants rent was more than 21 days in arrears.
- Where rent is at least 21 days in arrears on the date the landlord filed its application, the Tribunal must if requested make either a final or a conditional termination order pursuant to s 55(1)(a) and (1A) of the Residential Tenancies Act 1986. The tenants are already voluntarily paying off the arrears at $24.00 per week.
- The landlord is content with a conditional order. The Tribunal orders conditional termination with the parties’ consent.
- The conditional termination order will lapse if the tenants comply with it. If the tenants breach the order, termination will follow. The landlords may enforce the possession order for 90 days from the first breach in accordance with s 64(4)(b) of the Residential Tenancies Act 1986.
