- The landlord’s representative attended the hearing which I conducted by video. The tenant did not attend.
- The landlord has applied for termination of the tenancy for abandonment, rent arrears, and refund of the bond.
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date 1 .
- A tenancy is abandoned when the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- On 27 November 2025 the landlord became aware that the tenant had abandoned the premises. An inspection showed the premises were empty.
- Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
How much does the tenant owe?
- The landlord provided rent records which prove the amount of rent owing at the date of abandonment. The landlord is entitled to 3 weeks’ rent in lieu of notice from the date it discovered the premises abandoned.
- Some rent payments have been made since the tenant left the premises. The rent and rent in lieu of notice amounted to $4,635.85. The rent currently outstanding is $4,118.00. That is the amount I have awarded.
