- The tenancy of Joseph Martin Anthony Wiremu Manuera at Unit/Flat 1, 16 Aileen Place, Nawton, Hamilton 3200 is terminated, and possession is granted to Kāinga Ora–Homes and Communities, at 11.59pm on Wednesday 18 February 2026.
- Joseph Martin Anthony Wiremu Manuera must pay Kāinga Ora–Homes and Communities $1,229.86 immediately, being rent arrears to 16 February 2026.
Reasons
- Both parties attended the hearing which I conducted by video/phone. Ms Smith represented the landlord.
- The landlord has applied for termination of the tenancy and an order for rent arrears.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated 1 .
- The landlord provided rent records which prove the amount of rent owing as of 16 February 2026.
- Mr Manuera explained that he had been bailed to an address in New Plymouth was not able to return to Hamilton until his next Court appearance on 9 March 2026 when he will be sentenced.
- The landlord has also applied for termination of the tenancy for abandonment and for breach of the tenant’s obligations – the landlord’s tenants may not be absent for more than 30 days.
- I need not consider the alternate grounds. When rent is at least 21 days in arrears at the date of the application, a landlord has a right to apply to have the tenancy terminated.
- Mr Manuera said he could pay a lump sum towards his rent arrears and additional weekly payments. Ms Smith said that the landlord was not prepared to accept a conditional termination order.
- Because the landlord has proved rent arrears of more than 21 days at the date of the application (which Mr Manuera accepts) the Tribunal must terminate the tenancy. I have granted the landlord possession today since Mr Manuera will be absent until at least 9 March 2026.
- Ms Smith advised Mr Manuera that he can apply to the Ministry of Social Development for another Kāinga-Ora property once he has returned to Hamilton.
