Reasons
- A representative of Kāinga Ora–Homes And Communities (‘KO”) attended the hearing which was conducted remotely. The tenant did not attend. I am satisfied the Notice of hearing had been served on the tenant and in addition KO had reminded the tenant of the hearing. The hearing proceeded in her absence.
- The landlord has applied for termination of the tenancy and rent arrears.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- In addition, the premises were badly damaged and extremely unclean as well as being overwhelmed by possessions. KO have endeavoured to engage with the tenant, multiple times to provide assistance and engage social services that were able to assist her, but the tenant has not engaged at all with these offers of support.
