Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

The parties entered into a fixed-term tenancy to commence on 21 February 2026. The tenant was to pay a bond of $1,455.00 and one-week’s rent of $485 in advance.

There was an error in the paperwork, as the agreement recorded that the tenancy was to commence and end on the same date. It appears that this made it difficult for the previous adjudicator to make an order terminating the tenancy under the expedited abandonment process, where an order is made on the papers alone.

The tenant did not make any payments of rent or bond and did not move in. The landlord sought clarification from the tenant. On 22 February, the tenant advised he was unable to secure the bond. The landlord offered to terminate the tenancy by written agreement but the tenant did not respond.

When the tenant signed the tenancy agreement, he was bound by the terms of that agreement. That means either that he has to give 21 days’ notice for a periodic tenancy, or under a fixed-term tenancy, he is liable for rent until a new tenant is found.

However, the landlord is seeking no rent. He simply wants to end any binding agreement between the parties as soon as possible so that he can find an alternative tenant.

Based on the text and whatsapp communications, I find that by 22 February 2026, the landlord became aware that the tenant had abandoned the premises.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

Because Mark Richard Denize, Eian Denize has wholly succeeded with the claim I must reimburse the filing fee.
