Reasons
- The landlord attended the hearing which was held by video conference. The tenant did not attend. I am satisfied that adequate service of the hearing notice has been completed and considered it reasonable to proceed with the hearing in the tenant’s absence.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing. Taking into account the tenant’s circumstances, the landlord has delayed termination of the tenancy to 17 May 2026. It is reasonable to order all rent due to that date.
- The landlord also claims compensation for an oil leak on the driveway and the removal of rubbish from the garage. Photographs and an invoice were provided in support, and I am satisfied the claim is proved. Under sections 40(2)(a) and 40(2)(c) of the Residential Tenancies Act 1986, the tenant must keep the premises reasonably clean and must not cause damage. The oil leak and rubbish exceed fair wear and tear and amount to a breach of these obligations. Compensation is therefore appropriately awarded.
- As the landlord has wholly succeeded with the claim, I must order the tenant to reimburse the filing fee.
