Order
- Karora Tawa owes Kāinga Ora–Homes And Communities $590.00 (“the debt”) being rent owing to 13 May 2026.
- Karora Tawa must pay rent and the debt as follows: a. Payment of $590.00 for the debt, and b. Payment of $90.00 for weekly rent c. Both payments to be paid before 5:00pm on Wednesday 14 May 2026.
- Payments will be allocated in the following order: rent and then to rent arrears.
- If the tenant fails to pay rent and rent arrears within 10 working days of the due dates: a. The tenancy at 4 Valdale Road, Henderson, Auckland 0610 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- The landlord attended the hearing held remotely today. I telephoned the tenant however the phone did not connect.
- I continued with the hearing because the tenant has been posted notice of the hearing date and time to the tenancy address. The landlord has also visited the property and left a written reminder about the hearing.
Should the tenancy be terminated?
- The landlord has applied for termination of the tenancy because of rent owing.
- The landlord wants to agree on a repayment plan with the tenant, but he will not communicate with them.
- Rent was at least 21 days behind on the date the application was filed.
- The rent is 45 days behind on the hearing date.
- The law says the Tribunal must make either an immediate termination order or a repayment order with termination of the tenancy if any payment is missed or late (a “conditional termination” order); see section 55(1)(a) and (1A) Residential Tenancies Act 1986 (RTA).
- The tenant did not attend the hearing today and did not answer his phone so I cannot make a repayment plan. He is not here to tell me what he can pay.
- I have made a lump sum payment order. The tenant must pay the full amount of the debt ($590.00) and pay weekly rent ($90.00) due on Wednesday 14 May 2026.
- The tenant will be sent this order by post (he does not have an email address) so I have extended the payment timeframe to 10 working days.
- If the tenant does not pay the amounts above within 10 working days of the due date or does not agree with the landlord on a different payment plan, the landlord can terminate the tenancy immediately.
- If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. The conditional termination order will lapse if it is fully complied with.
- I encourage the tenant to urgently contact his housing support manager.
