Order
- Kruze Hetekia Ronnie Thom owes Kāinga Ora–Homes and Communities $601.00 (“the debt”) being rent arrears to today’s date.
- Kruze Hetekia Ronnie Thom must pay the debt as follows: a. By 60 weekly payments of $100.00, being $90.00 for rent and $10.00 for the debt. b. A final payment of $91.00, being $90.00 for rent and $1.00 for the debt. c. Payments will be every Wednesday, with the first payment on 20/05/2026 and continuing until 14/07/2027.
- Payments will be allocated in the following order: rent, and the debt.
- If the weekly rent payable is reassessed (either up or down) the weekly rent payable in order 2(a) and 2(b) above will be the reassessed amount.
- If the tenant fails to pay rent and rent arrears within 5 working days of the due dates: a. The tenancy at 3 MacEwen Place, Highbury, Palmerston North 4412 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- Only the landlord attended the hearing, which was held by video conference. Daniel Campbell represented the landlord.
- The landlord has applied for termination of the tenancy and rent arrears but would prefer a conditional termination so that the rent arrears is repaid over time and the tenancy can continue.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have reached this conclusion because the landlord produced a rent summary showing that for the past six weeks tenant has been paying his weekly rent together with an additional sum of $10.00 towards the rent arrears. I was advised that these payments are automatically directed from WINZ and so are likely to continue.
- I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
