- The Bond Centre is to pay the bond of $318.00 (X20146501) to Kāinga Ora– Homes And Communities immediately to reduce the debt owed by Mr Mason to $914.00 (‘the debt”)
- Christopher Mason must pay rent and the debt as follows: a. Weekly rent of $392.00 on the 20 March 2026 b. By 22 weekly payments of $432.00, being $392.00 for rent and $40.00 for the debt. c. A final payment of $426.00, being $392.00 for rent and $34.00 for the debt. d. Payments will be every Friday, with the first payment on 27/03/2026 and continuing until 28/08/2026.
- Payments will be allocated in the following order: rent and rent arrears.
- If the tenant fails to pay rent and rent arrears within 5 working days of the due dates: a. The tenancy at 29 Garaway Street, Whakatane 3120 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- Only the landlord attended the hearing. The tenant did not attend. I called the tenant twice on the phone number in the application but both calls went to answerphone.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears and refund of the bond.
Should the tenancy be terminated?
- Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.
- Rent is at least 21 days in arrears at the hearing date. The landlord provided records which show the tenant owes $1232 in rent as at today’s date.
- The Tribunal can make a conditional termination rather than final termination. Given that this has been a 24-year tenancy, and the tenant has been making rent payments on time since receiving the 14 day notice I have decided to grant a conditional termination rather than a final termination order.
- The conditional termination allows the tenant the opportunity to pay back the arrears at an affordable rate and remain in the property. If the tenant does not pay the rent, or the $40.00 per week in repayment of rent arrears on the due dates then his tenancy will come to an end without the landlord having to come back to the Tribunal.
- The landlord agreed today that it would accept the bond being paid to it now to reduce the amount the tenant owes.
