- Public Trust, being the Executor of the Estate of Paul Rawiri Wildman, is granted possession of the premises at 23 Cumberland Grove, Cannons Creek, Porirua 5024 immediately.
- For the sake of clarity, any person or persons residing or occupying the premises at 23 Cumberland Grove, Cannons Creek, Porirua is a squatter or trespasser without the right to occupy the premises.
Reasons
- Darryl Tua did not attend the hearing. The landlord attended the hearing by teleconference.
- The landlord is the executor of the estate of the late Paul Rawiri Wildman and has applied for possession of the premises at 23 Cumberland Grove, Cannons Creek, Porirua.
- Public Trust has submitted that Darryl Tua is living at the property, having been permitted to do so by his cousin, Aranga. Aranga held an EPOA (enduring power of attorney) for his mother, Helen, who lived at the property before Darryl. Helen was granted a life interest in the property by the will of her husband, Paul Wildman who died in 2008. Helen died on 31 May 2025. Public Trust now has the responsibility to sell the property and pay the debts of the estate.
- Where, on the application of any person entitled to possession of any residential premises, the Tribunal is satisfied that any other person is in possession of the premises as a squatter or trespasser, or otherwise than pursuant to any right of occupation granted to that person by any person having lawful authority to grant that right to that other person, the Tribunal shall make a possession order granting possession of the premises to the applicant.
- For these reasons, possession is granted.
