- The tenancy of Charlotte Arps at 8 Keri Place, Hei Hei, Christchurch 8042 is terminated, and possession is granted to Emerge Aotearoa Housing Trust, immediately.
- Charlotte Arps must pay Emerge Aotearoa Housing Trust $1,654.62 immediately, being rent arrears to 26 March 2026.
Reasons
- Ms Winder and Ms Mannion, representing the landlord, attended the video conference hearing. The tenant did not join the hearing as per the instructions in the Notice of Hearing and so did not attend the hearing. As the tenant was served, the hearing proceeded in her absence.
- The landlord has applied for termination of the tenancy and rent arrears.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord asked that the Tribunal consider immediate termination of the tenancy, given a drive-by shooting at the property recently, endangering the safety of the neighbours, and that they believe a number of other people have moved into the property. The landlord provided some evidence of the damage incurred at the property, which included photographs showing multiple broken windows, because of the shooting incident. As such, termination of the tenancy is immediate.
