Reasons
- The applicant attended the hearing which was conducted by video. There was no appearance for the tenant.
- The applicant has applied for possession of the premises under section 65 of the Residential Tenancies Act 1986, which says that the Tribunal must make a possession order granting possession of the premises to the applicant if: a. the applicant is entitled to possession of the premises; b. the Tribunal is satisfied that any other person is in possession of the premises as a squatter or trespasser, or otherwise than pursuant to any right of occupation granted to that person by any person having lawful authority to grant that right to that other person.
- The applicant has provided a copy of a certificate of title showing he is the registered proprietor of the property at 9455 Paeroa Kopu Road, Matatoki, RD 1, Thames 3578.
- The applicant told the Tribunal that he allowed the respondent to stay at the premises free of charge. He also used to live there too. She has never paid rent. The applicant now wants to sell the property but the respondent will not move out.
- The applicant also provided a copy of a letter dated 4 March 2026 from his solicitors to the respondent, in which it is confirmed that he is the owner of the premises, telling her to move out by no later than 18 March 2026, and warning her that she is trespassing.
- The applicant told the Tribunal that the respondent replied, asking to stay until 10 April, but she is still there.
- The applicant has established that he is entitled to possession of the premises and that the respondent has no right to possession. An order is therefore made granting him possession.
- Because the applicant has been successful, I must order reimbursement of the filing fee.
- Because there is no email address for the respondent, this order will be posted to the respondent. The applicant may wish organise service of this order on her sooner to avoid further delay.
