- Land Information New Zealand, on behalf of the Crown, is granted possession of the premises at 31 Grigg Street, Kaitaia 0410 immediately.
Reasons
- A representative of Land Information New Zealand attended the hearing. Mr Saulo and Ms Saulo also attended.
- The landlord has applied for a possession order of premises that are owned by the Crown. The premises, which consist of land and a residential dwelling, are held under the Public Works Act 1981 and administered by Land Information New Zealand (LINZ). The premises are part of the Crown’s ‘Treaty Settlement Landbank’, a portfolio of land held for potential use as cultural or commercial redress in future Treaty of Waitangi settlements.
- Mr Saulo and Ms Saulo are currently occupying the premises. However, they were unable to provide evidence to support that they have a legal right to occupy that has been given by the owner of the premises, or by an entity that has the lawful authority to grant a right of occupation.
- I therefore find, on the evidence before me, that Ms Saulo and Mr Saulo are squatters for the purposes of section 65 of the Residential Tenancies Act 1986. LINZ, on behalf of the Crown, are therefore entitled to possession of the premises.
