- Mr Tan owns the property at 2581 State Highway 1, Ruakaka. There is an older style house on the property and approximately 7 acres of land. Mr Tan used to rent out the house, but it has fallen into disrepair, and it has not been rented out for about a year. Mr Tan disconnected the power and water, and he intends to demolish the house. He leases out the land to a neighbouring farmer for grazing.
- Mr Tan was informed by the lessee and by the police that unknown persons had moved into the house without his knowledge or consent.
- The Tenancy Tribunal can make an order for possession if the Tribunal is satisfied that the applicant is the lawful owner of the premises and that anyone who is occupying the premises has no legal right to do so. 1 The Tribunal has jurisdiction to make an order for possession in those circumstances even though there is no tenancy. 2
- I am satisfied that the criteria are met in this instance. I accept Mr Tan’s evidence that there is no current tenancy in place, and he did not give permission for anyone to live there. The premises are not habitable.
- Mr Tan provided evidence that he is the legal owner of the property.
- The application is successful. I have made an order for immediate possession.
