Reasons
- The landlord attended the hearing by video conference. The tenant did not join the conference. I also tried calling the tenant.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. No rent has been received since 8 January 2026. The rent arrears are equal to about 9 weeks’ rent. It is appropriate to terminate the tenancy pursuant to section 55(1)(a) of the Residential Tenancies Act 1986.
- I would encourage the tenant to contact the landlord urgently. This is the first significant rent arrears in a 20-year tenancy. If the tenant had attended the hearing, it might have been possible to make a conditional termination order instead of a final termination order.
- The landlord provided a rent summary which shows the amount owing at the end of the tenancy.
