Reasons
- The landlord attended the remote hearing.
- The tenant did not attend the hearing by Teams video link. The Tribunal may hear matters in the absence of a party where satisfied that notice of the hearing has been given. I am satisfied that notice of the hearing was given to the tenant.
- The landlord has applied for termination of the tenancy for abandonment and rent arrears .
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- On 10 March 2026 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises.
- The landlord’s evidence was that the tenant had significant difficulty in occupying the premises. In November 2025, the tenant said that he was finding it hard to stay at the property, stating that he had been living in his car for long periods and returning to the premises only occasionally. He said that he had challenges settling into the home.
- From December 2025 through until February 2026, repeated home visits by the landlord’s staff found that the tenant was not present. Repeated efforts by the landlord to contact the tenant have not been successful.
- On 12 January 2026, the tenant admitted to the landlord that he had not lived in the property for three weeks. He also expressed an ongoing desire to leave the property. The landlord scheduled a meeting to meet with the tenant at the property on 13 February 2026. The tenant did not attend the appointment.
- In an effort to resolve matters, the landlord arranged for a formal meeting with the tenant on 17 March 2026. The tenant was advised that if he failed to attend the meeting the meeting that an application would be made to the Tenancy Tribunal to terminate the tenancy. The tenant did not attend the meeting.
- I am satisfied that the tenant has left the premises without reasonable excuse, not intending to return or to meet their obligations and that rent remains in arrears.
- As the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
