On 13 March 2026, the Tribunal issued its order on this application. It declared an amendment to Rule 6 (the allocation of parking and related matters) to be ultra vires.

Mr Skiauteris, the sole director of the applicant company, applied for a rehearing on the grounds that the Tribunal did not order reimbursement of the filing fee, nor consider an application for costs.

Through the registry, I advised that the reimbursement of the filing fee did not require an application for rehearing as I could address that by way of addendum to the decision dated 13 March 2026.

This order contains the addendum reimbursing the applicant company the filing fee on the successful application to be paid by the respondent.

The application for rehearing has not been withdrawn. I now dismiss it. There is nothing raised in the application that would require the Tribunal to consider, let alone grant, a rehearing.

I invited an application for any other costs from the applicant company, having previously noted that no legal costs could be sought as the Tribunal never approved legal representation.

Mr Skiauteris applied for an extension of the timeframe I set for him to file submissions addressing any costs he/the applicant company sought.

I granted that extension until 17 May 2026. The registry emailed my direction to the parties on 23 April 2026. I specifically noted that no further extensions of time would be granted and that I would issue my decision on costs if submissions were not filed by 17 May 2026.

The Tribunal has not received any submissions from Mr Skiauteris/ the applicant company.

The Tribunal (by addendum) therefore orders reimbursement of the filing fee on the successful application.

No other costs or disbursements are awarded.
