Are the unit owners liable for the levies and the interest invoice claimed?
- Unit owners must pay all body corporate levies and outgoings payable for the unit. 1
- For the outstanding levies, the body corporate determined the levies payable and unit owners’ share was calculated according to their utility interest.
- The body corporate fixed the due date for the levies to be paid, and the unit owners did not pay the levies by the due dates. 2
- The body corporate submitted background evidence and tables of calculations to prove the amount claimed which includes a modest amount for historical interest which relates to levies that the unit owners have already paid.
Are the unit owners liable for interest?
- If unit owners fail to pay levies by the due dates, interest accrues on the unpaid balance. A body corporate may charge interest up to 10 per cent per annum. 3
- The body corporate has resolved to charge interest at 10 per cent per annum on unpaid levies. The body corporate has proved the amount of interest owing from the due date to the hearing date.
Are the unit owners liable for costs?
- The Body Corporate is entitled to recover its reasonable costs incurred in collecting unpaid levies as a debt due to the body corporate. 4 1 Unit Titles Act 2010 (UTA) ss 80(1)(f) and 121(1). 2 UTA s 124(1). 3 UTA s 128. 4 UTA s 124(2).
