The tenancy of Oreon Broughton-Stowers at Unit/Flat 17, 250 Gloucester Street, Christchurch Central, Christchurch 8011, Gloucester Courts is terminated, and possession is granted to Otautahi Community Housing Trust, at
59pm on Wednesday 23 August 2023.
Oreon Broughton-Stowers must pay Otautahi Community Housing Trust $3,137.44 immediately, calculated as shown in the table below:

Reasons

This application was scheduled to be heard by teleconference. I rang the number provided for the tenant twice and on both occasions my call went to voicemail. The hearing proceeded in Mr Broughton-Stowers’ absence.
The landlord has applied for termination of the tenancy, rent arrears, reimbursement of the filing fee and payment of the bond.
Rent was at least 21 days in arrears on the date the application was filed and so Mr Broughton-Stowers’ tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
However, at today’s hearing Otautahi Community Housing Trust’s representatives expressed a willingness to continue Mr Broughton-Stowers’ tenancy provided he continued to pay $100.00 per week as he has been doing. Ordinarily the Tribunal would write up a Conditional Termination Order in these circumstances reflecting Mr Broughton-Stowers’ agreement to continue the weekly $100.00 payments towards rent and rent arrears and that if he failed to make this weekly payment within 2 days of it being due, then his tenancy would terminate immediately.
However I was unable to make such a Conditional Termination Order because Mr Broughton-Stowers did not answer his phone and so I was unable to obtain his agreement to it.
That being said, while there is no order detailing weekly payments, I have noted, for Mr Broughton-Stowers’ benefit, the landlord’s willingness to accept the $100.00 weekly payments rather than terminating his tenancy immediately.
For the same reason I have not ordered the bond to be paid to the landlord because the tenancy may well continue.
With regard to the amount of rent arrears, the landlord provided rent a record which proves the amount owing as at today’s date - $3,117.00.
Further to this, because Otautahi Community Housing Trust has wholly succeeded with the claim I must order Mr Broughton-Stowers to reimburse them the filing fee. C ter Haar 23 August 2023
