The tenancy of Charlotte Mitchell, Kylie Kilgour and Kirk Naylor at 5 Sylvia Road, St Heliers, Auckland 1071 is terminated, and possession is granted to Sylvia Kathleen Hubbard, at the end of Tuesday 8 August 2023.
The Bond Centre is to pay the bond of $4,400.00 (3655643-001) to Sylvia Kathleen Hubbard immediately.
Charlotte Mitchell, Kylie Kilgour and Kirk Naylor must pay Sylvia Kathleen Hubbard $6,951.76 immediately as outlined in the table below.

Reasons

Both parties attended the hearing. Ms Hubbard, the landlord and Ms Mitchell for the tenants.
Initially, the tenant wanted to adjourn the matter as she wanted to file a cross- application, seeking a credit for lawn mowing and labour provided for some renovations for the property.
This is a property that has a large lawn. According to the pre-inspection report, the property requires some work to it, like re-roofing, insulation and tiling. It appears the tenant has looked after the lawns, and contributed labour to reduce the cost of rental owing.
The landlord has applied for rent arrears, refund of the bond and reimbursement of the filing fee.
The tenant agreed the tenancy should be terminated and a date agreed for this was agreed being 8 August 2023.
The landlord and tenant discussed the amount of rent credit required and agreed that the rent owing being $14,131.32 be reduced by $2,800.00 for lawnmowing and further 40 hours labour provided by the tenant.
This will reduce the amount of rent arrears to $11,331.32.
Both parties agreed to the bond being refunded to the landlord to reduce the rent arrears further given a date of ending this tenancy is now agreed.
