Reasons

The Landlord attended the hearing by teleconference. The Tribunal telephoned the tenant on the cell phone number provided in the application. Someone answered the call and advised that the phone did not belong to the tenant and then hung up. I am satisfied that the tenant received notice of the hearing and chose not to attend.
The landlord has applied for termination of the tenancy for abandonment, rent arrears, refund of the bond and reimbursement of the filing fee on the application.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 27 June 2023, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord carried out a routine inspection that day and discovered that the tenant had left the premises taking most of her personal belongings. Subsequently, the landlord established following calls to the tenant that she had left for the South Island, was not intending to return and she had lost the keys.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
