The tenancy of Harley Tamihana and Rangi Tamihana at 11A Limbrick Street, Terrace End, Palmerston North 4410 is terminated, and possession is granted to Property Brokers Manawatu Limited, at 3pm on Friday 15 September 2023.
Harley Tamihana and Rangi Tamihana must pay Property Brokers Manawatu Limited $6,241.87 immediately, calculated as shown in the table below:
The Tribunal order made on 24 August 2023 is no longer in force.
The stay of proceeding made on 28 August 2023 is no longer required.

Reasons

Both parties attended the hearing. Ms Tamihana represented the tenants.
Ms Tamihana submitted that she and her husband separated about six months ago and he should have been taken off the tenancy agreement. I was not provided with any supporting documentation that Mr Tamihana asked to be removed from the tenancy and so this order is made in the names of both tenants.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy. The tenant submitted that she collected the keys on Thursday 9 June 2022 and they should not be charged rent for Tuesday 6 June and Wednesday 7 June 2022. The tenancy agreement signed by both parties states the tenancy started on 7 June 2022. Rent must be paid from the start of the tenancy as stated on the tenancy agreement. I find the rent summary starting on 7 June 2022 is correct.
Two rehearings of this application have been allowed. The bond was refunded to the landlord under an order made on 24 August 2023. The bond has been receipted and shown on the latest rent summary as a credit for the tenants.
The parties have agreed the tenant can have until Friday 15 September 2023 to move out and put her belongings in storage. The keys are to be returned to the landlord by 3pm so they can secure the property for the weekend.
Just in case there is any confusion if this order needs to be enforced, the order dated 24 August 2023 is no longer in force.
Because Property Brokers Manawatu Limited has wholly succeeded with the claim I must reimburse the filing fee.
