David Ould owes Barfoot & Thompson Property Limited As Agent For Louise Coleman & Nicholas West $4,120.44 (“the debt”) in accordance with the following table:
David Ould must pay rent and the debt as follows: a. By a payment of $600 on Tuesday 29 August 2023. b. By payments of the rent and $100 every Wednesday commencing on 6 September 2023 until the debt is paid in full. c. Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
If Mr Ould fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 10 Harbour View Road, Omokoroa, Omokoroa 3114 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If Mr Ould fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.
No application for suppression has been made in this case and no suppression orders apply around publication of this decision.

Reasons

Both parties attended the hearing which was held by teleconference. Ms Stanaway and Mr Rowe represented the landlord.
The landlord has applied for termination of the tenancy and rent arrears. Mr Ould agrees that rent is in arrears and seeks an ability to repay that before the tenancy is ended.
Where rent is at least 21 days in arrears on the date the application was filed, as it was here, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
As the parties have agreed to a payment plan, I have granted a conditional termination order as sought. Mr Ould must pay $600 tomorrow and then $100 plus rent every Wednesday starting next week.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
Because Barfoot & Thompson Property Limited As Agent For Louise Coleman & Nicholas West has wholly succeeded with the claim I must reimburse the filing fee.
