The tenancy of Stewart Willis at Unit/Flat 4, 934 Colombo Street, St Albans, Christchurch 8014 is terminated, and possession is granted to Craig Vernon Trowbridge and Louise Campbell Trowbridge, at 11.59pm on Thursday 17 August 2023.

The Bond Centre is to pay the bond of $510.00 (3601843-029) to Craig Vernon Trowbridge and Louise Campbell Trowbridge immediately.

This application was scheduled to be heard by teleconference. I rang the number provided for Mr Willis twice and on both occasions my call went to voice mail. The hearing proceeded in his absence.

The landlord has applied for termination of the tenancy, rent arrears, reimbursement of the filing fee and payment of the bond.

Rent was at least 21 days in arrears on the date the application was filed and so Mr Willis’s tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord provided evidence which indicates the amount owing as at today’s date.

Further to this, because Craig Vernon Trowbridge and Louise Campbell Trowbridge have wholly succeeded with the claim I must order Mr Willis to reimburse them the filing fee.

I note that at today’s hearing Mr Willis’s whereabouts was discussed. It appears that he has disappeared since mid-June and he has been listed as a missing person. His belongings remain at the tenanted premises and the landlord asked what she ought to do with them. Sections 62, 62A, 62B of the Residential Tenancies Act deals with disposal of goods. In essence foodstuffs or other perishable goods may be disposed of as the landlord sees fit. With regard to other items the landlord must make all reasonable efforts to contact the tenant and to agree with the tenant on a period within which to collect the goods.

If the landlord a. is unable to contact the tenant. b. is unable to agree with the tenant on a period for the tenant to collect the goods. c. agreed on a period for the tenant was to collect the goods, but the tenant failed to collect the goods within that time then the landlord must ensure that any personal documents are stored securely.

The landlord shall dispose of the other goods left at the premises by the tenant by: a. selling all goods with a saleable value by public auction or by private contract at a reasonable market price, and b. disposing of all goods with no saleable value as the landlord sees fit.

If it is not practicable for the landlord to the return the goods to the tenant and some of the goods have a value above the cost of storing, transporting and selling them. The landlord must sell these goods at a reasonable market price.

The landlord may deduct any amount owing from the sale proceeds, and must pay the balance to the Bond Centre. See sections 62(3)(b), 62B(2),(3) and (4), 62C(1)(b),(2) and (3) Residential Tenancies Act 1986). C ter Haar 17 August 2023
