The landlord asked for termination as at midnight tonight. This is because of the very high rent arrears and also damage at the tenancy premises. Another consideration is whether a bailiff will be needed. The tenant said she has no where to go. However, because the rent arrears are so high – more than 60 days behind as at today – it would be unfair to the landlord to let the tenancy continue beyond tomorrow.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing at the end of the tenancy. The tenant is sure that MSD made one more payment on 21 August 2923. If she can produce something in writing showing rent was paid for another week then she should let the landlord know as soon as possible. In the mean time I find the landlord has the better evidence here.
Because the landlord has wholly succeeded with the claim I must reimburse the filing fee.
