The tenancy of Tahu Coulston at 167B Ward Street, Cobden, Greymouth 7802 is terminated, and possession is granted to James Mark Sparrow, at 3.15pm on Monday 11 September 2023.
The Bond Centre is to pay the bond of $500.00 (3202754-020) to James Mark Sparrow immediately.
Tahu Coulston must pay James Mark Sparrow $1,770.44 immediately, calculated as shown in the table below.

Reasons

The landlord attended the hearing. The tenant did not attend.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and payment of the bond.
The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986 (the Act). A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 13 August 2023 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The fixed term of the tenancy ended on 2 July, but the tenant wanted the tenancy to continue, and he paid rent past the end date. He then spent some time in Hokitika, but it was unclear whether he had moved there. He did not return the keys. By 13 August the tenant made it clear that he would not be returning, and he removed some but not all his belongings from the premises.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes four weeks rent from 13 August as permitted by the Act.
The landlord had succeeded and so the tenant must pay the filing fee.
