The landlord provided photographs of how the premises were left. I am satisfied that the tenant did not leave the premises reasonably clean and tidy, and did not remove all their rubbish.
The landlord submitted a contractor’s invoice for the work required to clean and tidy the premises to return the premises to an acceptable condition.
The amounts ordered are proved.

Is the tenant responsible for the damage to the premises?

When the tenant was rushing to move out, the tenant’s son slipped on a wet floor and accidently damaged a wall.
The tenant carried out their own repair, which the landlord says was substandard.
The landlord has a quote for $408.25 to repair the damage. Mr Muhin says the repair is to be done after the Tribunal’s order is issued.
I am not confident the landlord will actually get the contractor to repair the allegedly substandard repair once this order is made. The tenancy ended nine months ago, yet the landlord has still not completed the repair. If the repair were necessary, it would have been done by now. 1 Section 40(1)(e)(ii)-(v) of the Residential Tenancies Act 1986.
I therefore decline to order the tenant pay for the quoted amount to re-repair the wall. Filing fee
The landlord has substantially succeeded in its application. Therefore, the Tribunal orders the tenant to reimburse the filing fee.
